The Constitutional Court canceled a single article of the law that gave authority to the Cabinet to remove limits on property sales to foreigners -- set at 2.5 hectares -- as long as the total area sold to foreigners does not exceed 30 hectares and is not more than 0.5 percent of the area of a province.
Under the directive, sales to foreign nationals and foreign companies will remain frozen unless a second directive stating otherwise is issued. The directive sent shockwaves through the investment world in Turkey, but the government said the Cabinet had already drafted and opened for signature a new bill on property sales that would swiftly end the chaos.

The new bill proposes taking the area of districts, instead of provinces, as a reference for determining the limit of land sales to foreigners. Later, the Cabinet will still have the right to review and allow purchase of more land in special cases, as long as the total area sold to a foreigner does not exceed this upper limit.

The draft was finished yesterday by the Land Registry General Directorate. Areas that will not be available for sale to foreigners based on their strategic location will be decided by the Cabinet based on proposals and opinions submitted by the relevant agencies. The Cabinet will assess the strategic importance of a location based on infrastructure, economy, energy resources, environmental conditions, cultural properties, security and agriculture.

State Minister for the Treasury Mehmet ?im?ek, currently on a visit to New York, had said on Wednesday evening that the government was working on passing a new draft to replace the law annulled by the Constitutional Court. “A new draft in harmony with the ruling of the court is under way, and we hope to pass it in Parliament in the near future,” he said, speaking to the Anatolia news agency.

Those in the real estate sector had warned that the suspension of property sales was a major threat to foreign investment Turkey, calling on the government to fix the problem as quickly as possible. 18.04.2008 Today’s Zaman

Are the Turkish Government right to Ban the Sale of Property to Foreigners?

Thank you for taking part in this poll. Click here to discuss this subject or any other concerning Turkish property investment further.

The Turkish Government Ban the Sale of Property to Foreigners

The Turkish govenment has banned the sale of property to non-Turkish residents. Most importantly you get to meet the people involved in the project and sometimes even get to see other projects they have completed and get an idea of their levels of workmanship.

I am delighted to announce that this week has seen the launch of Propertyshowrooms.com’s very own Inspection Trip Department, kicking off with 2 of my favourite regions in Turkey, Bodrum and Fethiye, amongst others.

The trips will start at £99 per person and this fee could even be refunded if you were to go on to buy a property. Once again we seem to have something for everyone, from 1 bedroom apartments all the way up to a 5 bedroom secluded villa on its own private island. For further information on the properties available to view on the inspection trips please click here.

I think from the response we have seen so far to the inspection trips shows that there is definitely a market for them if you do things in the correct manner.

If anyone out there has recently been on an inspection trip to Turkey, good or bad, I would be interested to hear your thoughts as to what made the trip a pleasant experience or what it was that made it horror story?!

Buying property in Turkiye,

Buying property in Turkiye,

Regarding solicitors and lawyers,it is quite simply essential that you appoint an independent local solicitor who speaks English to represent you.

There are many checks and searches that need to be conducted on the title of a property etc., and these must be done by a professional solicitor otherwise you run the risk of encountering problems either with the purchase or later resale of the property. It's unlikely you'd buy a house in your home country without seeking the assistance of a solicitor so don't be tempted to proceed in Turkiye without a solicitor,On top of the purchase price, are there any extra taxes or fees payable?

Yes, There are some extra costs.

A 3% of the property value tax. This is a once off payment and it is due for payment once the (deed)TAPU is received.

The solicitor's fee.
Prices start from about £300 and will vary depending on which solicitor you choose.and the area you decide to buy in,

A 3% agency fee that covers all agents commision and charges. This is usually payable at the time that the contract is made, together with the initial deposit payment on the property but may be able to be negotiated in certain circumstances.

It is compulsory to have earthquake insurance and we recommend you take out,
The cost of earthquake insurance (DASK) works out at 1YTL per sq meter for you house/apartment + 3YTL.,So a 75 sq mt house is 78YTL.

You are adviced to get full home and contents insurance cover as soon possible
Or once the property is registered in your name.(the cost of this varies depending on the value of the property, it's contents for the number of months it will be occupied.) Approximately £150

Turkish Home/ property insurance is available in the UK as well as Turkiye,

You are adviced also to get the water and electricity into your name so the bills will come directly to your house.

Maintenance charges - these apply to properties that share communal facilities and can vary from as little as £80 - £500 annually

Note,
Certain restrictions apply relating to the areas in which foreign buyers can purchase land or property and a simple guideline is that if a property is close to Turkish military land or bases permission will be denied. The owners of all new build developments targeting overseas buyers can usually provide proof that apartments and villas for sale qualify for sale to foreign buyers and if in doubt make sure your solicitor checks out any property you're interested in before you sign a contract to buy.

This is to provide basic information about buying property in Turkiye.
The information in this post is of a general nature and does not constitute legal advice,
Article posted with the permission of www ourturkishlove.com

You can also see relevant issues regarding Buying property in Turkiye, here,

www.turkisheconomy.org.uk/buyingproperty/property.html

Relocation Guide for Turkey

Relocation Guide for Turkey

In most areas of Turkey finding accommodation to rent or buy isn't difficult, providing your requirements aren't too unusual. Accommodation accounts for around 25 per cent of the average Turkish family's budget, but can be more in the major cities. Property prices and rents in Turkey vary considerably depending on the region and city.

It is very practical to have a street map of the area where you are going to live. Check out the local tourist information office for free copies. Even after you have found your home, you will find a street map invaluable for getting around.

Residences Permits

According to the provisions of Law no.5683 of 15 July 1950, persons who come to Turkey as tourists may stay Four months without a residence permit, unless there is a restriction in their visa or a separate provision in the visa agreement between Turkey and their country of origin. Generally the period stipulated in visa agreements is three months. ( NOTE İS SAY'S THREE MONTH'S ON YOUR VİSA THE ACTUAL REAL TİME İS 90 DAYS..!! )Persons who wish to stay longer in Turkey are required to apply to the security authorities for a residence permit.

Rent (Kiralik) or Buy (Satilik)

If you're planning to stay in Turkey for only a year then renting is usually the best solution since the costs associated with purchasing a house can be 10% of its value. However with the upsurge in the popularity of Turkey as a holiday destination buying is a safe and good investment.

Furnished or Unfurnished

Most rental properties in Turkey are let unfurnished, particularly for lets longer than one year. Furnished properties are difficult to find and generally poorly equipped. Note that "unfurnished" doesn't simply mean without furniture" in Turkey. An unfurnished property is usually an "empty shell" with no light fixtures, curtain rods or even a television aerial. There's also no cooker, refrigerator, dishwasher and there may even be no kitchen units, carpets or kitchen sink! Always ask before viewing as you may save yourself a wasted trip. If the previous tenant has fitted items such as carpets and kitchen cupboards, he may ask you to reimburse him for the cost. You should be prepared to negotiate the price and make sure that you receive value for your money.

Areas

If you want to live in an area where there are many international residents it is best to check out where the schools and hospitals are. Contact your embassy or international social organizations and ask the international residents.

Costs

Rents for a 2-bedroom apartment in the south of Turkey start at £175 - 200 per month, while a 3-bedroom house start around £200 - 250 per month. In addition, you might pay a real estate agent up to 1 months rent. Then you might need to buy kitchen cabinets and maybe pay for redecoration.

Types of Housing

Many Turkish families live in communal property developments where rents are
lower than in the town centers. Rents are calculated according to the number
of bedrooms and the floor area (in square meters). Generally the higher an apartment is in a block, the more expensive it is (you pay for the view, the extra light, the absence of street noise, increased security and the rarified air). However, if a block doesn't have a lift, apartments on lower floors may be the most expensive.

In case of a Dispute with the Landlord

If you have a complaint regarding a long-term rental, you should report it to the local municipal office (Kaymakamlik). If they're unable to help you, they will direct you to the office where you can make a formal complaint. Depending on the type of dispute you may be directed towards a solicitor.

This is to provide basic information about relocating to Turkey. The report strongly praised the nation for its economic recovery in recent years, for the continued policies of reform in a bid to maintain exceptional GDP growth and for the country's commitment to the implementation of further fiscal, political and judicial reforms aimed at making Turkey one of the most competitive nations in which to invest, work, do business and live.

The report highlighted the work that still needs to be done in Turkey to boost the nation's attractiveness for foreign direct investment but it indicated that Turkey was on track for making the necessary changes, lowering excessive taxation burdens and minimum wage costs to attract more international businesses to Turkey.

On course to be in Top 5 in 2007

Furthermore, as Turkey proved earlier this year with fundamental improvements to the rights of foreign buyers of property in Turkey, the nation is working to improve the rights of foreign citizens wishing to invest in land and real estate in Turkey and it is working to improve transparency in law and bureaucratic processes to this end.

The positive legal changes to the rights of foreign buyers of property in Turkey that were exacted in January 2006 have so far resulted in excellent levels of buyer confidence in the Turkish property market and over 6,000 sales of property to overseas buyers were finalised between the law change in January and July 2006 alone.

While the appetite for foreign second homes, holiday properties and investment assets remains strong and European economic and interest rate environments continue to be kind to investors, the Turkish property sector will continue to expand, says Amberlamb. The property investment experts point out that Turkey is currently on target to return in excess of 12% capital growth in 2007 putting it well within the top 5 European nations in terms of real estate appreciation potential.EU membership on the horizon?

Meanwhile positive developments are continuing across Turkish economic and political life as the nation continues with its bid to become a member of the European Union. While everyone is aware that Turkey must overcome many obstacles and exact far reaching changes if it is to achieve accession, no one can doubt the nation's commitment nor the positive economic effects that potential entry has already reaped.

Turkey has become one of the strongest recipients of foreign direct investment into its construction and property industries from GCC nations with the largest GCC FDI commitments having been made following a decision earlier this year to allow Turkey to begin talks aimed at structuring the nation ready for EU entry.

In raising Turkey's profile during the beneficial talks with the European Union, the Turkish government not only won strong financial support from the GCC group of countries it also succeeded in promoting Turkey as an interesting, diverse, approachable and welcoming nation among the international travel and tourism community. As a result the World Travel and Tourism Council recently responded to dramatic developments in the tourism market in Turkey and released exciting predictions for the country suggesting that in the next decade an already healthy tourism market will double in terms of economic activity. This would in turn result in strong GDP growth, the creation of jobs in Turkey and the attraction of exceptional levels of foreign direct investment, Amberlamb predicts.

All indicators are that Turkey is on the right path to enjoy a journey of positive economic expansion and international acceptance and as a result it is one of the most exciting emerging nations in the world for property investors right now. Turkish property offers investors a low entry price, long-term capital appreciation potential and immediate and strengthening rental appeal therefore it has made it into the top five on Amberlamb's 2007 property investment watch list.

SOURCE: PRWeb
Turkey .Kusadasi the four areas

Kusadasi the four areas

1. Town / Centre
2. Ladies Beach
3. Long Beach
4. Davutlar Guzelcamla

Kusadasi Town
If you are looking for a house to stay 12 months a year town is the place to look for one. Although very crowded during summer, town is busy 12 months a year. You do not need a car for this region. Most of the town is walking distance and you may also use the regular minibus (dolmus) service within town which runs on regularly between 7:00 AM 11:30 PM. The negative side of town is that you need to take a dolmus (minibus) to reach beach or you may walk to the public beach in downtown. Shopping is easy as almost all the shops are open 12 months a year. Restaurants, cafes and bars are also open throughout the year. In summary those who are thinking about staying during for winter should look for a house or apartment in town

Ladies Beach Region
In summer, Ladies Beach area, one of the most preferred area in kusadasi located 2 kms south of town. The down side of having a house in Ladies Beach is that the region is dead between November 1 and May 1. If you are planning to stay during summer ladies Beach can be the right location for you. The sandy beach is 1 km long and is usually very crowded during July and August. Houses in this region are usually dublexes with small gardens. There are also many sites (group of houses) in Ladies Beach. There is regular minibus (dolmus) service between town and Ladies Beach. It is a 5 minute dolmus (minibus) ride and a 15 minute walk to town The shops are open between May 1 and November 1, some market shops are open 12 months a year. It is very quite in winter and therefore should be considered as a spot for summer season.

Long Beach Region:
Long Beach is located 10 kms south of and like Ladies Beach it is lively in summer and completed deserted in winter months. A 10 km long sandy beach. Summer houses and a couple of hotels are scattered parallel to the beach. You would be lucky to find a house right on the beach. Most of the available ones are in the second, third or fourth lane and are 100 to 200 meters away from the beach. The are convenient store that are open between May 1 and November 1 in this area. However, for major shopping you need to go to kusadasi There is also one of the major aqua park of Turkey, Long Beach Aqualand in this area. If you are looking for a quite location, Long Beach area can be the right place for you. There is regular minibus (dolmus) service between long Beach and kusadasi town running between 7:30 AM 11:30 PM. In winter this service is not regular. The last minibus (dolmus) leaves kusadasi at 7 pm.

Davutlar Guzelcamla
Davutlar and Guzelcamlik are two small towns located 20 kms south of towards the end ofkusadasi Bay. The famous National Park (Kalamaki) is near this region. You may do your grocery and other fundamental shopping in the bazaar of Davutlar or Guzelcamlik. National Park (Kalamaki) is 1 km away from Guzelcamlik and is a preserved paradise for visitors. Pine Tree Forest reaches the shores of Aegean Sea. The crystal clear sea of National Park makes it a perfect beach location. Most of the houses in this region are duplexes with small gardens. The water front houses are rare to find and expensive compared to those situated behind. This region is quite deserted in wintertime. There is regular minibus (dolmus) service between these two towns and kusadasi running between 7:30 AM 11:30 PM during summer and more rare service continues during winter The prices of houses are significantly lower in this region. If you are planning to stay during summer only this region along with Long Beach is a choice you should consider.

A final word of warning, This is from personnel experience,

Long Beach+ Davutlar Guzelcamla can become very isolated in the winter months. If you miss the last minibus (dolmus) The only other form of transport is a taxi. This can prove to be very expensive if you are wanting to visıt kusadasi often for nights out. There is a big problem in the winter month's in Long Beach+ Davutlar and Guzelcamla with dogs that have been abandoned. They can be be very threatening to some.

My views and thoughts after living in and around kusadasi for ten years. I am sure there will be other's that disagree with them, Please if any one wants to copy and paste this feel free. But give me some credit for it...

Regard's

Tommy.
purchasing process in Turkey.

After the sale and purchase conditions are agreed upon you and/or your Agent are advised to ask for a copy of the TAPU (Title Deeds) and double check whether:

1-The TAPU really belongs to the property
2-It is a residential property in a zone covered by an Implementary Development Plan or a Local Development Plan
3-The property really belongs to the person who introduced himself to you as the "owner"
4-No annotation prohibiting the sale/purchase of the property appears on the TAPU
5-The property complies with all regulations
6-All licenses and official permits for the property had been properly obtained
7-The current owner does not owe taxes anything to the Tax Office
8-The current owner owes no over-due debts to the utility companies

Contracts are not compulsory according to current regulations and mutual declaration of both the buyer and seller to the TAPU (Title Deeds) Registry Office is enough to carry out the transfer of ownership, a contract will allow you to protect yourself. If you are using a real estate agent and/or solicitor ensure the contract refers to them and that they also sign the contract. Your contract should include the following:

1-A detailed description of the property (address, TAPU details, technical conditions etc)
2-The actual price to be paid to the seller for the property
3-The seller's bank account details for payment
4-The agent and/or solicitors bank account details for payment
5-The payment terms and conditions to the seller including deposit, interim and final payments
6-A Statement requiring the seller and the buyer to pay their own tax liabilities
7-The fees and commissions to be paid to the solicitor or agent
8-Under what conditions and how the money paid by the buyer will be refunded by the seller
9-Whether parties can give up the sale/purchase, if so, under what conditions this can happen
10-The rights and responsibilities of the persons whose signatures appear on the contract
11-ID numbers of Turkish nationals (TC Kimlik No) who are to sign the contract, the Barr registry number of the solicitor being used and the trade registry number of the real estate company

Before signing the contract have it translated into English. Relying on only an oral-translation may lead to unwanted situations in the future. Sign the contract in the presence of a notary public and then have them notarized. This will ensure that:

1-The people signed the contract and their signatures are genuine
2-The contract is in line with Turkish laws and officially acceptable anywhere in Turkey
3-The terms within the contract are binding for all parties

The next step for both buyer and owner or their legally authorized agents is to apply to the TAPU Office for transferring of ownership. During the application the buyer or their agent are to provide the local TAPU Office with the following documents:

Buyer
1-Title Deed or a document indicating the property's exact location (plot or parcel number etc.)
2-2 recent passport photos of the buyer
3-Passport and/or ID Card of the buyer

Agent
1-An acceptable Power of Attorney
2-2 recent passport photos of the agent
3-Passport and/or ID Card of the agent

Upon your application the local TAPU office will do a search on behalf of whether the property is in a forbidden zone or not. After military clearance has been finished you are given an official ownership document called the Title Deeds (TAPU). Without having a TAPU you are never considered to legally own the property even if you signed a legally acceptable purchase contract with seller.

This is to provide basic information about the purchasing process in Turkey. The information in this post is of a general nature and does not constitute legal advice.

You want to reside in turkey.

Turkish Residence Permit
According to the provisions of Law no.5683 of 15 July 1950, persons who come to Turkey as tourists may stay Four months without a residence permit, unless there is a restriction in their visa or a separate provision in the visa agreement between Turkey and their country of origin.
